2. Scope of Services

E COM IT provides service-based offerings including but not limited to:

  • eCommerce consultation and strategy
  • Web design and development
  • Marketplace and platform management
  • Digital transformation support
  • Performance and growth consulting

All services are tailored to each client based on agreed project briefs or service-level agreements (SLAs).

3. Engagement & Communication

Upon engaging with E COM IT:

  • Clients agree to provide timely and accurate information necessary for service delivery.
  • Project timelines and deliverables are mutually agreed upon before the commencement of work.
  • All communication regarding progress, approvals, or revisions will be documented for transparency and accountability.

4. Fees & Payments

  • Fees are quoted based on the scope of work and complexity of the project.
  • Payments must be made as per the agreed milestones or invoicing schedule.
  • Delays in payment may result in project hold, suspension of services, or additional charges.
  • All prices are quoted in Sri Lankan Rupees (LKR) unless otherwise stated.

5. Intellectual Property

  • All content, strategies, designs, and development created by E COM IT remain the intellectual property of the company until full payment is received.
  • Upon completion and full settlement, the client will own the final deliverables unless otherwise agreed.
  • E COM IT retains the right to showcase non-confidential project work in its portfolio.

6. Service Limitations & Liability

  • While we strive for excellence, E COM IT does not guarantee specific business outcomes such as sales figures or growth metrics unless contractually stated.
  • We are not liable for losses incurred due to third-party services, platforms, or client-side issues beyond our control.
  • Clients are responsible for maintaining their login credentials, data backups, and platform compliance (e.g., Shopify, WooCommerce, etc.).

7. Revisions & Changes

  • Reasonable revisions are allowed within the project scope.
  • Major changes or additions requested outside the agreed scope may result in additional charges and timeline adjustments.

8. Refund Policy

Our refund policy is outlined in a separate document titled Return & Refund Policy, which is an integral part of these terms. Refunds, if applicable, will only be issued after mutual discussion and if E COM IT has failed to meet its agreed obligations.

9. Termination

Either party may terminate a service engagement with written notice. If terminated:

  • The client must pay for all work completed up to the termination date.
  • Any advance payments will be adjusted based on the work already delivered.

10. Governing Law

These Terms & Conditions are governed by the laws of Sri Lanka. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Sri Lanka.

11. Modifications

E COM IT (PVT) LTD reserves the right to update or modify these terms at any time. Clients will be notified of significant changes. Continued use of our services after updates constitutes acceptance of the revised terms.
